1. Acceptance of Terms

By accessing and using GIF Resizer ("the Service"), you accept and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

These Terms constitute a legally binding agreement between you and GIF Resizer. Your continued use of the Service signifies your acceptance of any changes to these Terms.

2. Description of Service

GIF Resizer provides free, browser-based GIF processing tools including:

• Resize GIFs to custom dimensions
• Compress GIFs to reduce file size
• Convert GIFs to other formats (MP4, WebP)
• Edit and optimize GIF files

All processing happens entirely in your browser. We do not upload, store, or have access to your files. The Service uses WebAssembly technology (ffmpeg.wasm) to perform operations locally on your device.

3. User Responsibilities

When using the Service, you agree to:

• Use the Service only for lawful purposes
• Not process files that contain illegal, harmful, or offensive content
• Not violate any intellectual property rights or other rights of third parties
• Not attempt to circumvent any security features or limitations of the Service
• Not use automated means (bots, scrapers) to access the Service excessively
• Not reverse engineer, decompile, or attempt to extract source code

4. Acceptable Use Policy

You may NOT use the Service to process, create, or distribute content that:

• Infringes on intellectual property rights (copyrighted material without permission)
• Contains malware, viruses, or malicious code
• Violates privacy rights or contains personal information without consent
• Is illegal, harmful, threatening, abusive, harassing, or defamatory
• Contains adult content, violence, or material harmful to minors
• Promotes discrimination, hatred, or violence against individuals or groups

While we do not monitor or access your files, we reserve the right to terminate access for users who violate this policy.

5. Intellectual Property

Your Content: You retain all rights to the files you process using the Service. We do not claim any ownership or rights to your files.

Our Content: The Service, including its design, code, features, and branding, is protected by copyright and other intellectual property laws. You may not copy, modify, or distribute any part of the Service without permission.

Open Source: Portions of the Service use open-source software (ffmpeg.wasm, Next.js, etc.) licensed under their respective licenses. These licenses are available in our code repository.

6. Privacy and Data

Your privacy is important to us. Please review our Privacy Policy to understand how we handle your data.

Key points:

• All file processing happens in your browser
• We do not upload, store, or have access to your files
• We use Google Analytics for anonymous usage statistics
• We do not collect or store personal information

7. Disclaimers and Warranties

AS-IS SERVICE: The Service is provided "as is" and "as available" without warranties of any kind, either express or implied.

We disclaim all warranties, including but not limited to:

• Warranties of merchantability, fitness for a particular purpose, and non-infringement
• Warranties that the Service will be uninterrupted, secure, or error-free
• Warranties regarding the accuracy, reliability, or quality of results
• Warranties that defects will be corrected

Quality of Results: While we strive to provide high-quality processing, we do not guarantee the output will meet your specific requirements. Results depend on your input files, browser capabilities, and device performance.

8. Limitation of Liability

To the maximum extent permitted by law, GIF Resizer and its operators shall not be liable for any:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or use
• Damage to your device, software, or files
• Loss or corruption of files processed through the Service
• Costs of procurement of substitute services

This limitation applies whether the claim is based on contract, tort, negligence, strict liability, or any other legal theory, even if we have been advised of the possibility of such damages.

Backup Recommendation: We strongly recommend keeping backups of your original files before processing them.

9. Indemnification

You agree to indemnify, defend, and hold harmless GIF Resizer and its operators from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney fees) arising from:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any rights of third parties
• Content you process through the Service

10. Service Availability

We strive to maintain the Service's availability, but we do not guarantee:

• Continuous, uninterrupted, or error-free operation
• That the Service will always be available
• That defects will be corrected immediately

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time without notice. We will not be liable for any modification, suspension, or discontinuation of the Service.

11. Termination

We reserve the right to terminate or suspend your access to the Service at any time, with or without cause, with or without notice, for any reason including:

• Fraudulent, abusive, or illegal activity
• Prolonged inactivity

Upon termination, your right to use the Service will immediately cease. Since we do not store user data, termination does not affect any files you've already processed.

The Service may integrate with or link to third-party services:

• Google Analytics (analytics)
• CDN providers (unpkg, jsDelivr for ffmpeg.wasm)
• Hosting providers

We are not responsible for the content, privacy policies, or practices of third-party services. Your use of third-party services is at your own risk and subject to their terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where GIF Resizer operates, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the Service shall be resolved exclusively in the courts of that jurisdiction.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to this page with an updated "Last updated" date.

Your continued use of the Service after changes are posted constitutes your acceptance of the modified Terms. We encourage you to review these Terms periodically.

Material changes may be announced through the Service or via other communication channels.

15. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
